AN EYEWITNESS has told a jury a nightclub promoter was kicked and punched in the street before being shot in “an execution”.

Stuart Turner was watching from the window of his flat as 27-year-old Daniel Herbert was shot dead in Clements Road, Bermondsey, at around 2am on August 17, 2009.

Bobby Winser, aged 22, from Bermondsey, and Michael Campbell, aged 25, from Camberwell, are standing trial at the Old Bailey accused of murdering Mr Herbert, who lived in Holywell Close, Orpington.

This morning Mr Turner told the jury he and his girlfriend were awoken by the sound of Mr Herbert being attacked and together they looked out the window of their flat.

Mr Turner said: “There was one person on the floor and there were four or five guys around him. He was cowering on the floor, trying to protect himself.”

He added: “It was like a pack of wolves. They were just attacking him. They were kicking and punching him.

“Once they had finished kicking and punching him, most of them stood back and Daniel was lying on the floor and was not trying to get up or get away or escape.”

He added: “One of them kneeled beside Daniel and picked him up by his collar. Then I just saw a spark and heard a bang.

“There was no warning he was going to be shot.

“I had a rough idea of where he had been shot. It was on the right side of his head.

“It was pretty much like an execution.”

Mr Turner told the jury his view from the window was partially obscured by a tree, and that it was too dark to get a clear view of Mr Herbert’s attackers before they ran away.

He said that after they had gone, he told his girlfriend to phone an ambulance and ran down to the street to Mr Herbert.

Mr Turner said: “I checked to see if he had really been shot. It was like a crater in his head.”

The jury heard that Mr Turner was able to see that Mr Herbert’s attackers were all white, and that one of them was wearing a blue striped t-shirt.

However, he was unable to pick out the attackers during two identity parades in August 2009.

Earlier this morning, Mr Herbert’s best friend Elisabeth Hughes gave evidence.

She told the jury Mr Herbert had told her about a botched burglary he had taken part in.

Previously, the jury had heard that Mr Herbert was involved in a burglary at the home of Winser on August 12, 2009.

Miss Hughes said Mr Herbert had told her he went to a house with two other men known as Glen Ward and Tang to try to steal a bag containing £50,000.

However, the burglary went wrong and Mr Herbert was chased from the house while carrying the bag containing the money, which he threw back at one of his pursuers before escaping.

Miss Hughes told the jury Mr Herbert phoned her afterwards to say he was “very worried” about what Mr Ward would do to him for giving up the money.

She said: “He was more worried about what Glen would do to him than the boys he had robbed.”

Darren Mitchell, aged 42, and 68-year-old Doreen Mitchell, both from Eastbourne in East Sussex, are standing trial alongside Winser and Campbell.

Both Mitchells are accused of assisting an offender. It is alleged they gave false information to police following Mr Herbert’s death.

The four defendants deny all charges.
