A POLICE informant has described to a jury how the uncle of a murder defendant told him his nephew was involved in the killing.

Daniel Herbert, of Holywell Close, Orpington, was shot dead in Clements Road, Bermondsey, at around 2am on August 17, 2009.

Bobby Winser, 22, from Bermondsey, and Michael Campbell, 25, from Camberwell, are standing trial at the Old Bailey accused of murdering the 27-year-old nightclub promoter.

The jury has heard Winser and Campbell were arrested after Winser’s uncle, Darren Mitchell, told a friend they were involved in the killing, and the friend, who was secretly a police informant, then told the police.

Yesterday the informant gave evidence and described Mitchell calling him to his home in Eastbourne, East Sussex, to tell him about the killing.

He said: “I went into Darren’s bedroom, which used to double up as a place to talk quietly and smoke.

“Almost immediately I could see Darren was in a state of shock and shook up and upset.

“As it was said to me by Darren, I already knew that his nephew was growing plants and had been robbed of a couple of his harvests.

“Darren told me that the people who had robbed [Winser’s] cannabis harvests twice had done it a third time and that Bobby had come home and just missed his burglars.

“I understand (Bobby) backed away from his door and looked up and down the road and saw someone on the common and they made eye contact.

“Upon making eye contact, the other guy ran and Bobby gave chase.

“Bobby caught this fellow. He struggled with him and wrestled him to the ground and got the better of him and was punching him from above, sitting astride him.

“And then another person that I did not know and still do not know, Michael, caught up with Bobby.

“After the chase and the sweat that produced, and the exertion of chasing this guy, he smelled the smell of his own skunk weed coming off the guy, which infuriated him.

“He turned around to Michael and said ‘shoot him, f*****g shoot him’, expecting Michael to shoot him in the leg or arm perhaps – somewhere non fatal.

“Michael shot him through the head.”

The informant said the phrase Mitchell used to describe the shooting was “he put one through his nut”.

He told the jury that after Mitchell had told him about the killing, they came out of the bedroom and Winser was in the front room with Mitchell’s mum, Doreen.

Darren Mitchell, aged 42, and 68-year-old Doreen Mitchell, both from Eastbourne, are standing trial alongside Winser and Campbell.

Both Mitchells are accused of assisting an offender.

It is alleged they gave false information to police following Mr Herbert’s death.

The four defendants deny all charges.
