A man from south east London who strangled his ex-wife after a night partying has been spared jail. 

Evaldino Oliveira, 53, of Hurst Street in Herne Hill, admitted strangled his former partner and assaulting another woman. 

After coming home drunk on October 29 he forced his way into their home and pinned his ex-wife on the bed, prosecutor Frances McCormack said. 

“He put both hands around her neck and squeezed hard with both hands,” Ms McCormack said. 

It was only when another woman in the house intervened that he let go. 

Police were called to the home and Oliveira was arrested. 

When he was interviewed he told police he’d grabbed her by the throat “to calm her down”. 

The day after the incident he appeared at Croydon Magistrates’ Court where he pleaded guilty to intentional strangulation, assault by beating and damaging his ex-wife's iPhone. 

At Inner London Crown Court on Friday (January 19) Oliveira appeared via videolink from HMP Wandsworth.

Judge Jane Rowley issued a restraining order which will last for two years. 

She also sentenced Oliveira to one year and three months in custody, suspended for 18 months. 

“It’s very rare in cases such as these that suspended terms are imposed, but it is a result of his early guilty plea and previous good character.” 

Oliveira was also ordered to pay £1,000 in compensation.
