NO CHARGES will be brought following the death of a man who stopped breathing while being arrested.

Frank Ogboru, 43, from Nigeria, was on holiday when he was arrested by police officers following a disturbance in Calderwood Street, Woolwich, on September 26 2006.

Mr Ogboru stopped breathing and attempts were made to resuscitate him.

He was taken to Queen Elizabeth Hospital, Woolwich, and was pronounced dead at 11.44pm that night.

The Independent Police Complaints Commission (IPCC) examined the circumstances of Mr Ogboru's death.

A file was submitted by the IPCC to the Crown Prosecution Service on December 6 last year but it has decided there is insufficient evidence to justify the prosecution of any of the police officers involved.

The IPCC will now send the file to the Met for their recommendation as to whether any disciplinary action is proposed before the commission makes a final decision.

A Met spokesman said: "The death of Frank Ogboru in September 2006 is a matter of deep regret to the Met and we wish to take this opportunity to extend our deepest sympathy to his family and friends."
