AS EXCUSES go, not having a ticket because you wrote your phone number on it and gave it to a pretty woman on a train is certainly imaginative.

And it is one which ticket inspectors heard before giving the 20-year-old man in question a fine.

Revenue protection officers working on train services across the News Shopper area hear stories like this every day and issue countless fines.

Train watchdog Passenger Focus says this ‘privatised justice’ needs to be dished out more carefully so people who make a genuine mistake rather than an excuse are dealt with fairly.

They include William Gatward who wrote on the Passenger Focus campaign page on Facebook about how he was fined at Dartford station.

He did not realise the town is outside the Oyster zone and so had not bought a ticket for the last part of his trip and said: “This was a mistake on my part, but why didn't the attendant just let me buy a ticket for the excess part of the journey?”

Passenger Focus’s chief executive Anthony Smith said: "Any form of privatised justice like this must be administered according to clear guidelines, be accountable, give passengers a fair hearing and not assume everyone is guilty.

"Train companies cannot continue to treat some of their customers like this – ‘one strike and you are out’ is simply not fair."

In response a spokesman for the Association of Train Operating Companies, on behalf of Southeastern, said: "We are already working on an industry-wide code of practice that will set out how operators deal with fare dodgers and where discretion can be shown for passengers who have made an honest mistake.

"Train companies need to take a firm but fair approach to fare dodging because unfortunately there will always be people who try to get away without paying.

"The overwhelming majority of the three million people who travel by train every day get the right ticket for their journey with no problems whatsoever."

A Southern trains spokesman said: “The national conditions of carriage clearly set out the terms by which passengers must travel and at Southern, we operate according to these conditions.

“However, our on-board staff do have the option of using discretion where a case may be in doubt.

“Any passenger issued with a penalty fare has the right to appeal to the Independent Penalty Fares Appeals Service within 21 days of the date of the penalty fare.”

I also once made the mistake of not knowing Dartford was outside the oyster zone and ended up being surrounded and intimidated into paying £20 on the spot and also lost £7 odd on the oyster card because it wasn't touched out, I wrote and contested the fine but haven't heard a word back from them 14 months later!
I think it is outrageous that you pay more in fines for an honest mistake than you would if you simply didn't bother buying a ticket! I was also told I couldn't pay the fare and had to pay £20 or the police would be called, even though I am sure it costs less than £7 for a ticket to Dartford and the oyster system automatically deducts a maximum fare if you don't touch out so I had paid enough to cover my travel anyway, it is just a money making scam on the part of the train operators, wouldn't it be interesting to get a freedom of information request to find out how many people have been ripped off at Dartford by these greedy train companies....

i have also been a victim at dartford but last week or so ago the inspector let me threw as i had my work gear on and i went back the next day and payed for the ticket even tho they let me off...on another note 2 years ago when i was 18 me and my friend went to central london , we got on at orpington but the ticket machine didnt work and no one was at the desks so we jumped on the fast train to london bridge and got surrounded by a group of btp and staff ordering to show our tickets, obviously we didnt have one so we explained our story and guess what!, they didnt belive it i got fined £240 and had to take the day off work to travel up to the south eastern trains office on tooley street to pay my fine

Something that can catch people out is that you can use your Oyster card all the way to Bluewater on either the 428, 492 or the 96 bus, But then with the zones on the Railway they only go as far as Crayford, Barnehurst and Slade Green. Some people who are new to Oyster Cards or who don't usually travel to Dartford could quite easliy be led to believe the Oyster works at Dartford as the barriers there have the Oyster tapping pads on them (or at least they used to have them unless they have now been removed) But my point is there is enough space on trains and platforms to inform commuters where the Oyster ends.
You do get some understanding "ticket officers" (sorry but "revenue protection officers" Really? If you polish a turd, it's still a turd) And you also get proper bullies which is totally unacceptable and uncalled for.
