Driver of Bexley Council's CCTV car accused of sleeping on the job

A DRIVER of one of Bexley Council's CCTV cars has been accused of sleeping on the job.

Ben Hanachi, 44, says he took pictures of the employee napping in the vehicle on January 23 at around 9.30am in Yarnton Way, Thamesmead.

He told News Shopper: "She was well asleep with headphones on. I took some pictures then knocked on the window and showed her the camera. She opened her eyes and drove off."

The tree surgeon added: "If you pay someone to do a job, why should they fall asleep on a main road? It's a stupid place to choose to have a kip."

CCTV car driver in Yarnton Way, Thamesmead

Mobile In-car Camera Enforcement vehicles (MICE) use CCTV to catch people parking illegally across the borough.

A penalty charge notice is then sent to the owner of the vehicle by post.

Mr Hanachi, of Templar Drive, Thamesmead, says he was fined £120 by the council last year when he stopped on double yellow lines to let someone cross the road.

He appealed the decision and the fine was quashed.

Mr Hanachi said: "Since the fine I decided to carry a camera with me so every time I see them (CCTV cars) doing something wrong I take a picture."

Si Clark, a member of No To Mob, which campaigns against council CCTV cars, said: "It's a waste of money for the council to have camera cars.

"It's more efficient to have on-street enforcement. This has just proven it's a complete waste of money."

A council spokeswoman said: "The photos are inconclusive on their own.

"NSL, the Civil Parking Enforcement contractor for the London Borough of Bexley, is currently looking into the matter and will wait until all facts are known before deciding whether any action needs to be taken.”

Motorist angered by parking fine 'con'

A WIDOW was left "shaky and stressed" after receiving a £60 parking fine despite claiming the pay machines were out of order.

On Monday (January 30) at around 9.45am Linda Hill parked her car in Oaklands Road car park in Bexleyheath.

The 61-year-old went to put money in the machine but there was an 'out of order' hood over it.

Mrs Hill, of Erith Road, Bexleyheath, said: "I put a note on the car saying the machines were out of order with £1.40 on the dash board.

“I also explained in the note I didn't have a phone with me."

But when she returned from a beauty salon at 10.30am the covers had been taken off the machines and she had received a parking ticket.

The mother-of-one said: "To me it seems like a con.

"I'm just shaky and stressed out because it's a lot of money to me."

A council spokeswoman said she could not comment on individual cases and added: "The process enabling motorists to challenge the issue of a penalty charge is shown on its reverse, and the council will consider all such challenges objectively."

Mrs Hill was lucky, I parked in the same car park at about 8pm on a Friday night to go to the bowling alley. A parking attendant watched me park, go to the ticket machine for a ticket and then decided to pounce.

People complain about these people, but not being funny, most (and I know not all) parking tickets are genuine. If you park on double yellow line, or single yellow at the wrong time, you can't really complain if you get done! The amount of people I've heard moaning that 'they only stopped to nip in a shop'. Tough! That's the risk you take.

Agreed, but why should we have any respect for anyone who aspires to be a traffic warden and then sleeps on the job?

It's pretty much the same in Greenwich. I see every day the council workers sit in their vans smoking and chatting for the last hour or so of their shift.

Councils still spend tax payers money like there was no tomorrow. The same principles as in the private sectorshould apply, ie. if you don't perform or if there is not enough work to do you are fired.

Taking into account the cost & maintenance of the vehicles, training of drivers and other staff, office premises for administration staff and salaries of drivers and administration staff it is probably costing us more than keeping them unemployed and on benifits where they should be, instead of creating jobs for them all at or expense!

no is not my job,i do carry camera to catch some nice photo's of wildlife,but wen i seing her asleep i thought she make a nice frame and good headline in the local paper so at least we all know now wy we pay council tax and were the money goes.

To be fair (asleep or not) I'd drive off if I opened my eyes and saw you and your mate with your faces up against the car window, laughing your heads off and pointing a camera. Scary stuff!

She also escapes to her mothers house for a few hours most days only lately she has been hiding elsewhere and now got caught!!!! Have complained several times but nothing is every done.... She carries on doing nothing..... She deserves the sack in mu opinion

Listener, why do you complain and want her sacked? Do you want her job??

Are you an outraged council tax payer who resents where your hard earned money gets spent? Please think of all the services you get before you arrive at cctv car driver as an answer.

Or are you are an outraged taxpayer who is going to watch someone with a job and paying tax go to being unemployed and claiming benefits (including housing and council tax)?

I have absolutely no idea who this woman is but because Mr. Tree Surgeon once got a ticket and decided to make it a personal vendetta now you also decide she's not doing her job "cos you know her" and where she allegedly spends all her day. 'Avin a laugh!

i'd like to point out a few things when it comes to the issues drivers have with traffic wardens, etc.

i'm confident enough to say to say that the female in the cctv car wasn't asleep at that time as i personally know and work with her... the cctv cars require constant observation inside the vehicle to assess any contraventions taking place... even that said, the female in the vehicle naturally sits like this in the cctv car as it is very cramped in the car with all the equipment and can give us back pain if we dont sit in certain ways...

we have many people from the public like mr hanachi taking pictures of us on a daily basis trying to catch us in the wrong...

for those who say that we park illegally, well we dont... we have authorisation from bexley council to park on single/double yellow lines, etc wherever you may see us and before doing so at each location, we seek that authorisation for an all clear.

as for the female who recieved a parking fine in oaklands road car park... as far as i can say, if the machines are out of order then don't park there... displayin money in your dash dont do anything cos we wont wait there to collect it.

there is no such thing in this country as free parking if there is a pay machine in that car park...

the reason for pay by phone function is for that purpose, if the machine doesn't work or you dont have loose change...

yes maybe, its not her fault that the machine was out of order but there was other means of pay ie. by phone... but then again its not any traffic warden or bexley council's fault that she doesn't have a phone, etc to pay by phone...

there is another car park literally 30 seconds opposite in which she could have parked and paid or park on the near side roads that are free parking. bexleyheath borough is full of car parks.

traffic wardens and cctv cars are there for a purpose... if you commit a contravention be it a minor or serious one, then you give us a chance to actually be on the road.

theres 1 simple answer to this, noone pay their fine untill te council change there ways. I never register my car to my address, if you don't pay your fine and a court baliff decides to come and clamp your car he will have a wasted journey, the worse that will happen is your get a ccj to your name and whats that? absolutly nothing so you might have troube obtaining credit in the future, who wants credit anyway, credit equals debt, britain fights back lol

You have to laugh that its oks to block the road after 6.30 and be legally parked but put two wheels on the pavement while you pop in a shop thus freeing up the traffic and the cctv cars will give you a ticket.
So if its not about raising revenue why is this a regular occurance ? Its certainly not about keeping the roads freely moving when this policy encourages blocking the flow of traffic.
Seeing my mate get a ticket whilst dropping someone off at blackfen was plain crazy, he had two wheels on the pavement for a whole 8 seconds as recorded by a cctv car.

The thing is they not even supposed to be used in this way they are only supposed to be usd where it is unpractical to use a traffic warden ie on the A2 etc.They only get away with it as its not law and only guidelines.

Thats it parking people keep killing off local trade by targeting all those small parades of shops that rely on people parking up and popping in.And when all the small shops are killed off by stupid parking restrictions we can all go tescos for everything.

Totally agree with you , but how comes they park in restricted areas whilst filming you. I dropped the missus off on a yellow line, didnt even park and the next week got a fine. Yet they are parked illegally themselves. She wasnt sleeping though!!

What stupid advice! Just in case anyone is daft enough to think that getting a CCJ is no big deal, I'd point out that you may get trouble getting a mortgage. Secondly, don't ever bother to try to get a job in the financial sector as FSA rules means that banks, etc can't employ such people.

Presumably this joker thinks he's the right to park where he wants. Let's hope some time they catch up with you and crush your car.

I have a business on Blackfen Road, everyday I see the little smart car and not once have I seen it's driver asleep with legs a kimbo on the dash board.
So either NSL & Bexley council are breaking health & saftey regulations, or you, the friend of the sleeping driver, is telling porkies.

Unfortunately I think you're fighting a losing battle to get people on here to use the English language in its correct form. I can accept someone may not have perfect grammar, but can't stand the use of 'text speak'. It bugs me like crazy!

If Bexley get a lot of these types of issues then surely it would be easy to sort this out or am I missing something? It is a Camera car! Put a camera on the inside of the car to monitor the Health and Safety of the operative!! If you know what I mean!!!

I think we are very lucky to have people like Ben, who are prepared to carry cameras with them in case they see somebody taking a rest.

I'm also delighted that Ben is doing this in the public interest and is in no way motivated by feelings of petty revenge.

Anyway Anyone who gets a ticket always contest it espeacilly if you suspect it was issued wrongly or have a valid reason ffor why you were parked there. And use there system loads of photographic evidence. As most of them are issued illegally.
Example I got off a ticket outside the civic offices in Bexleyheath about 4 years ago on a double yellow. I had a valid excuse for parking there and got off with it. Because I did my homework and found out the ticket was issued ilegally which since then I have got people off with loads of tickets. But only those who were genuine and had a case.

Ben should really get a life, after all he was not fined as such, he appealed the ticket & won. There are better uses of precious spare time than taking photos of Bexley traffic wardens.

Linda IMHO should appeal the ticket, & see what happens. Just for once, I agree with the statement from Bexley Council.

BigG - What was your 'good reason' for parking on double yellow lines? I don't think that there are many good reasons. Most parking tickets are valid. Like it or not, parking restrictions exist and one has to pay for car parks. If you fail to do this, you get a ticket. Not rocket science!

It was my wife actually who broke down. This I expalined to the parking services who still rejected the circumstances. This is the sort of people they are everyones a liar and they have no compassion as their wardens don't.
Anyway I got off with it because the yellow lines went round into the Marriott and they wasn't T'd off at the end. After they had to drop it a week later they t'd them off. Funny that! they know that most of their tickets are issued wrongly, and rely on people to pay instead of challenging them. I'm not one of them people. And then there are people like yourself that defend their actions. Are you a traffic Warden???? or work for one of our the corrupt councils.

Maybe the driver was being intimidated by this man and trying to avoid him. I’m guessing they come in for a lot of abuse doing their jobs. Maybe the real shot he was after was one of the driver reacting angrily to him so he could post that on a website and snigger like a schoolboy - but all he got was one of her hunched up and avoiding looking at him. Maybe he was **** when he didn’t get the reaction he wanted so he made up some lame story anyway. Guess what, my family album has several photos taken over the years showing people with shut or half eyes – they weren’t asleep though, the camera just caught them at the wrong moment. Good for NSL for wanting to find out the facts first. As they said, photos on their own are inconclusive.
As for Linda, I sympathise – but you have to look at the bigger picture. Supposing it was the mobile phone and pay system that had crashed. Would mobile phone users suddenly have been allowed to park for free? I don’t think so – they’d have had to pay cash and if they didn’t have cash they’d have had to park elsewhere.
By the way, I think these parking patrols do a great job. When my kids were at school I was glad to see them fining selfish drivers parking illegally by school gates and causing a hazard to the kids. I am also glad to see them fining selfish drivers who block bus stops so they can get to the shops easily – but cause problems to older folk and people with wheelchairs or pushchairs who then struggle to get on or off the buses which are forced to park away from the kerb.
There are always cases which are an exception to the rule, and the appeal system is there for that. Other than that, the people who are the most bitter and twisted about parking tickets seem to be the ones who deserve them most.

I agree with not parking outside schools on zigzags. That's the sort of thing wardens should do. But all this is never about keeping roads clear or safety. Its all about, how much the councils can screw out of you. Those who defend their system either don't drive or just the usual do gooders that get involved with s""t that don't concern them. And those who says she's awake, someone who knows her says she slopes off to her Mums. And u wouldn't be relaxed as that if someone was snapping you

Big G - No I'm not a traffic warden and my work has no connections to the council nor do any of my family! Just my general opinion is that a lot (not all) of the time, these people get a hard time. If you're broken down on yellow lines, that's fair enough. But I do hear a lot of people moaning that 'they were only 5 mins over their ticket' or 'only stopped on the yellow line to nip in a shop'. Then they feel hard done by to get fined. The rules are pretty clear.

Please ask the company concerned for a copy of the risk assessment to see what their findings were and the controls that would have been introduced. You probably be told no as you don't have a devine right but sometimes firms are happy to produce the occaisonal copy.
And no, I don't work for the cctv firm or the council, before anyone asks or throws abuse at me!!

At the end of the day, it's easier to look at it like a game of footie.
If you want to cheat by diving in the area to get a penalty to win and you get away with it...well done (not condoning diving or cheating) but the next time you may not get away and be caught fair and square. You can't then moan about being given a card for cheating.
A strange way of looking at it but it works!
I suppose the only answer that can be given and can not be argued against although those people who get caught will try is...if you don't want a ticket, don't stop where you're not supposed to!!

I've just had another look at the close up photo...the attendant actually has her eyes open!
The angle of the shot plus the eye makeup makes it look as though her eyes are shut but they are open!!

Was just wondering as the "sleeping wardens" friend confessed that they have to sit in that position ( legs on dashboard ) because of the cramped conditions!
The smart cars I've seen daily for the last 8 months parked on Blackfen Road, the drivers sit upright..

I'm a trained driver assessor among my other qualifications and have been asked a number of times to do an assessment on drivers who comment upon or complain about the vehicles they drive.

I spend 2 or 3 days with them in a vehicle to develop a sense of trust by which time, the driver will have relaxed and naturally revert to their normal driving standard - anyone who knows they're being looked at will adopt a posture that is correct as far as the highway code is concerned and therefore present a false image.

90% of the time it is poor posture caused by the individual and not the vehicle.

I bet that if you could see the risk assessment, it will show somewhere that a contol measure to manage 'musculo-skeletal' issues will include the ability to get out of the vehicle and move around.

As mentioned, I've assessed these cars when working in other businesses and I've not experienced the need to sit like that. I've found them comfortable and suitable for the use they were being put to.
Personally, I wouldn't have one as I just don't like them as a model but that's my preference.
Oh, and I'm 6'4"!!!

Be careful in filming anything, you could be in breach of the Data Protection Act by taking someones image where they can be easily identified.
There are exceptions to this but what your proposing could be seen by that individual as a breach of their privacy.
If you did that to me, I WOULD pursue you through the Courts for breach of my privacy and possibly slander as in this case you are making what could be - not saying it is or isn't but could be, an unfounded or damaging comment against my character!

It is only friendly advice so please don't come back on the attack, you could make yourself look foolish!

Read the Bexley Chronicle about Bexleys Camera Cars, that they are not legal and donot have a valid certificate to operate them.
So if anyone has had a penalty charge from one, then look into it.
