A POLICE informant has been accused of lying when he told a jury a murder defendant had admitted being involved in the killing.

Daniel Herbert, of Holywell Close, Orpington, was shot dead in Clements Road, Bermondsey, at around 2am on August 17, 2009.

Bobby Winser, 22, from Bermondsey, and Michael Campbell, 25, from Camberwell, are standing trial at the Old Bailey accused of murdering the 27-year-old nightclub promoter.

The jury has heard Winser told a friend of his uncle he was involved in the killing, and this friend, who was secretly a police informant, then told the police.

The informant told the jury Winser said he had attacked Mr Herbert for burgling his home, where he was growing cannabis, and then Campbell had shot him in the head.

However, the informant was accused of lying about Winser telling him this.

Alexander Cameron, defending Winser, said the informant had “put Bobby Winser and Michael Campbell into the frame for the shooting”.

Mr Campbell said the informant had “added in little details to embellish the tale” when giving evidence.

Mr Campbell added: “In your version of these events, Bobby Winser sits astride the deceased man, so Daniel Herbert was lying on the road or the pavement and Bobby Winser was sitting on top of him, punching him.

“And it’s at that point that you add in another detail about the smelling of his own skunk weed [on Mr Herbert].

“You say the reaction is to turn around and say ‘shoot him’ [to Campbell].

“You were never told any of this by Bobby Winser, were you?”

The informant replied: “That’s rubbish.”

Winser’s uncle Darren Mitchell, 42, and grandmother Doreen Mitchell, 68, who live together in Eastbourne in East Sussex, are standing trial alongside Winser and Campbell.

Both Mitchells are accused of assisting an offender. It is alleged they gave false information to police following Mr Herbert’s death.

The informant told the jury Darren Mitchell had told him about Winser’s involvement in the killing, and that he discussed the shooting with Winser in front of both Mitchells.

But Lewis Power, defending Darren Mitchell, said the informant was wrong about this.

Mr Power said: “Darren Mitchell did not think Bobby Winser was involved in the murder, did he?”

The informant replied: “Yes.”

All four defendants deny all the charges.
