UPDATE - BROMLEY: Ex-police officer spared jail over sex act on duty


A FORMER Met Police officer who had oral sex with a woman while on duty has been given a suspended prison sentence.

James Formby, who was a Bromley-based PC, was given a 20-week jail term suspended for two years and ordered to carry out 200 hours of unpaid work when he appeared at Southwark Crown Court today.

Formby, who admitted the charge of misconduct in public office on January 26, was also ordered to pay £1,000 court costs.

The 31-year-old was charged following an investigation by the Independent Police Complaints Commission.

The charge related to an incident on September 19 last year when Formby and three other officers went to a flat in Bromley in response to a report of a domestic disturbance.

After officers entered the flat, a man was arrested and taken away for questioning, leaving Formby to take a statement from the 33-year-old woman.

Prosecutor Michael Mulkerrins said: “She had been drinking and was mildly and relatively drunk.”

Mr Mulkerrins told the court the woman was sitting on the living room floor and the pair began flirting. She put her head on Formby's knee, initiating the sexual contact.

Formby told the woman she looked "sexy" in her grey leggings.

Mr Mulkerrins added: “Her boyfriend was a male stripper and there were various uniforms he would wear and this added to the sexual tension between them.”

The court heard how Formby followed the woman into the toilet. The pair then went into the bedroom and began kissing, and the woman performed a sex act on Formby.

Later that day the woman made a 999 call during which she referred to what happened.

Mitigating, Richard Atchley said the woman had been drunk and had taken BZP, an ecstasy-type drug.

Mr Atchley said: “He [Formby] realises he has been very foolish and could have and should have left the house straight away.”

Sentencing, Judge Nicholas Loraine-Smith said: “Your behaviour that night has led to the end of your career.”

Bromley police borough commander Chief Superintendent Charles Griggs said after the sentencing: “We are all horrified by Formby's conduct.

“His career is over and he will never work as a police officer again. I believe the sentence reflects the seriousness of the breach of trust in this case.

“As soon as the complaint was made, Bromley police arrested the officer and referred the matter immediately to the Met's Directorate of Professional Standards and the Independent Police Complaints Commission.

“The Metropolitan Police Service is committed to ensuring our officers behave professionally and with utmost integrity.”

He added: “I sincerely hope that this incident does not affect the confidence that people have in their police. Victims, and the most vulnerable, must be able to feel safe and protected.”

Formby handed in his resignation after admitting the offence.

One bad apple out of how many. They do a good job considering the flack they get from the public and the foolish Goverment. Your lucky you don't see any that means it's not a bad area. If you see them all the time then be careful.

This not only highlights not only the incompetence and unprofessionalism of our police force in this country but also how many instances of misconduct and incompetence there really are within our police force…Police officers are meant to set an example….Shame on them!!
Acts such as these normally get covered up and this is the function of the Professional Standards Dept (PSD) within each police force and it is their task to “play down” and “gloss over” the many complaints they receive and prevent them from being made public or being taken any further, such as a prosecution. They do a good job of protecting, defending and “sheltering” their officers who commit acts of misconduct and incompetence!
It is not surprising that so many complaints are now raised against the police.For information, in 2008 two complaints that were deemed upheld & substantiated were against the same officer within Thames Valley Police Force, DC Mark Torrington who is based in Banbury. The complaints were raised through the IPCC and after an investigation by the Thames Valley Police Professional Standards Dept (PSD) it was concluded that both complaints against were indeed upheld and substantiated.
The complaints were for “Improper Disclosure of Information” and the investigation report details that DC Torrington disclosed personal & private information and data to the complainants employer on a regular basis and continually providing “updates”, therefore breaching the Data Protection Act 1998. Due to this breach Thames Valley Police have also been reported to the Information Commissioners Office (ICO).
The second complaint which was also concluded as being upheld & substantiated was for “Mishandling of Property”. This involved the same officer, DC Torrington giving away various personal possessions & items of the complainants property to an unauthorised person and also without permission or even recording it.
The investigation report details and concludes that DC Mark Torrington will receive Management Advice from the Area Commander as a result of his actions.
This officer should have been prosecuted in the same way as any member of the public would have been!
However this once again highlights the poor conduct of officers and the very low standard within Thames Valley Police which on many occasions just gets “glossed over” from the public. The actions of this officer are just one example of why Thames Valley Police have got such a poor reputation and proves that officers including DC Torrington obviously can not be trusted!!

You sound like ex job. If it wasn't for a few brave men & women were would this country be. They went above the call of duty when certain events happened to members of my family. Don't tar them all with the same brush.

Chief Inspector Porkpie - Glad you had a good experience with the law. Unfortunately you are in the minority!! Kin chavs all over the gaff, stabbings and burglaries and the old bill are having their old bill sorted out by the woman of a man they had taken away. The great british bobby eh...!!!
