An 81-year-old man has vowed to continue his four-month fight with Bexley Council over a parking ticket he got due to a “misleading” sign he says is entrapping drivers.

John Borders, from Farnborough, got a parking ticket in Bexleyheath Broadway on Saturday, November 18 and is now calling on the council to make restrictions in the area clearer.

Mr Borders parked in a zone designated for loading opposite Asda, but he says the sign is misleading and the council should do more to make it clearer that it is a no-parking zone.

A ticket was issued to Mr Border's car at 20.15pm on a Saturday, at a time he claims it is reasonable to assume parking was legal.

He said: “All it needs is a sign. It is either a loading dock or it is not.

“The signage is misleading to say the least. It needs to be made clearer that there is no parking because the public will continue to park there.”

The sign says the area is loading only between Monday to Saturday during the hours of 8am and 7pm, no return within one hour.

Mr Borders says other that any other signs are not remotely near where he parked, and it isn't clear enough.

“It is confusing, that is the main problem without a doubt. I’m not within the loading period, so it must not be a loading dock.

“As far as I was concerned I could have stayed until 7am. It is in the interest of other people for it to be signed better. As far as I was concerned, I hadn't ignored any 'no parking' signs.”

Mr Borders returned to the area weeks later on a Sunday and says he saw two other cars with tickets which had parked in the bays.

“In the absence of any other sign I thought it was fair. There are no yellow lines on the floor, I wouldn’t just park anywhere I couldn’t. The sign says nothing about the time out of hours. All it needs is a sign.”

A spokesperson for Bexley Council said: “Mr Borders was issued with a parking ticket as he was parking in an ‘at any time’ restricted parking zone.

“Restricted parking zones do not have yellow lines as they have zone signs. Should he wish to pursue a formal challenge Mr Clifford should follow the process outlined in the ‘Notice to Owner’.”

Mr Borders said he won’t give up fighting the council.

He said: “I could go back there every weekend and take the same photos of cars parked there.

“It is quite reasonable to expect a sign up there. It is unfair and will drivers will continue to get caught. If it is not a loading dock in those hours, what is it?”
