COURT of Appeal judges have revealed their reasons for throwing out the Health Secretary’s legal bid against Lewisham Hospital campaigners.
A report breaking down the court’s decision to uphold an earlier ruling that Jeremy Hunt did not have the power to downgrade A&E and maternity services at Lewisham was published on Friday (November 8).
Lord Justice Sullivan gives the judgement that the TSA had only been appointed over South London Healthcare Trust and “no other trust” such as Lewisham and Greenwich NHS Trust, which runs Lewisham Hospital.
The report also notes that cases where it could be justified to give wider powers to TSAs and the Secretary of State were matters for Parliament – where a new clause to the Care Bill is being considered - and not the court.
