Woolwich racist attack over tweet 'praising killing of Lee Rigby'
A PORTUGUESE national burst into his local takeaway in Woolwich and shouted at a Muslim worker “you’re killing our soldiers, you don’t deserve to be here” three days after Lee Rigby was killed.
Jose De Avila, 47, launched into a tirade of racist abuse before spitting at Hassan Mahamoud who was serving behind the counter at Super 1 Fried Chicken in Woolwich New Road on May 25.
The unemployed regular customer at the fried chicken shop claimed the Somalian victim’s brother Kacy had posted a message on Twitter praising the killing of Fusilier Rigby.
Appearing at Woolwich Crown Court yesterday (October 3), De Avila, of Woolwich Common, close to the soldier’s barracks, was given a suspended prison sentence for racially aggravated common assault and possessing an offensive weapon.
Prosecutor John Coates told the court that the defendant shouted: “Where’s Kacy? What’s Kacy putting on Twitter?
“You’re Muslim scum, you’re killing our soldiers, you don’t deserve to be here.
“Go back to your own country where you came from. You’re taking money from white people.”
Mr Coates added: “He (De Avila) then spat over the counter at Mr (Hassan) Mahamoud face. It landed in his hair and the front of his forehead.”

De Avila then walked out of the takeaway at around 7.20pm before he was arrested by police who found a kubotan knife in his pocket.
The defendant, who ate at the shop two or three times a week, pleaded guilty to the two charges at a hearing on September 5.
On sentencing De Avila to four months in jail suspended for 18 months, Recorder Adrian Lynch QC said: “Others were in that restaurant and it was a public denigration of Mr Mahamoud's religion.
“Having already abused Mahamoud's religion, the defendant then spat in the face of Mr Mahamoud and the defendant recognises it’s an insulting act to spit in someone’s face.
“The defendant said the victim’s brother had made a comment praising the murder of Lee Rigby. Lee Rigby’s barracks were very close and your neighbours were part of the same community.
“He did so in public, in the victim’s place of work.”

Recorder Lynch later added: “It’s clear the defendant has a number of difficulties with his attitude and tolerance of cultural diversity and also in terms of his drink and drugs, namely cannabis.
“I accept the defendant is significantly aware of his problems and has been dealing with them.”
